Pro-SLPP lawyers decry misinformation spread against Gotabaya
A group of lawyers supporting Sri Lanka Podujana Peramuna Presidential candidate Gotabaya Rajapaksa is threatening legal action against persons purposely misinterpreting the verdict given by a US court over a case filed against him.
One of the lawyers Mohan Weerakoon PC told reporters yesterday they expect to file a case for defamation against these activists, who they said “gave a wrong idea about the verdict given by the California district court to media in a press conference, in Ahimsa Wickremetunge’s case against Gotabaya Rajapaksa.”
Ahimsa had filed a case in a California court demanding compensation from Gotabaya for the death of her father Journalist Lasantha Wickremetunge for which she blames the former Secretary to the Ministry of Defense. The case was dismissed as the court found that it did not have the jurisdiction to deal with it.
Weerakoon said that they had completely distorted the judgement either because they do not understand English or they willfully and purposely wanted to bring disgrace to Rajapaksa.
Another lawyer Razeek Zarook PC said that an election should be fought in a democratic manner and is being subverted by using various issues to disqualify Rajapaksa.
He also said that they have been attempting from the beginning to prevent him from contesting this election, “there were series of court cases which challenged his citizenship status,” he added.
Speaking about Ahimsa Wickrematunge court case against Gotabaya Rajapaksa, Razeek said that case was dismissed by the district court of California based on a purely preliminary technical objection as there was absolutely no jurisdiction.
And he said as there was no substantial evidence, “you can’t go on a speculative basis without substantial evidence,”
Further, Weerakoon said this is done by the UNP government where an innocent girl like Ahimsa has been used to file this case in the US.
A quote from the motion filed by Gotabaya Rajapaksa’s party according to Kushan de Alwis PC says “as many Sri Lankan citizens are following this case Mr Rajapaksa (Gotabaya) wishes to make it clear that assuming the truth of the allegation for the purposes of this motion in no way coincides there truth on the contrary Mr Rajapaksa vigorously disputes the allegations,”
De Alwis also said that in the First Amended Complaint (FMC) which was filed by Ahimsa in July 2019, an objection was taken that the case was brought against the former secretary defence and a current presidential candidate just before the election in Sri Lanka and that it has no place in a court in the US.
