Petition seeking suspension of election gazette

Former Galle Mayor N. G. Methsiri de Silva filed a petition in the Supreme Court this afternoon requesting a writ order declaring the gazette notification on the upcoming presidential election illegal.

The United People’s Freedom Alliance (UPFA) mayor filed the petition arguing that President Maithripala Sirisena’s six-year term will not have been completed by 16 November, the day of the election as announced by the Elections Commission in said gazette.

In addition to suspending the gazette notification, the petitioner also seeks a declaration that the Commission’s call for nominations on 7 October also be suspended.

The crux of the petitioner’s argument appears that holding the election on 16 November would effectively reduce the President’s term to five years, which would go against the sovereignty of the people.

Commissioner Mahinda Deshapriya and other commission members have be named as respondents.
