Shafi case: CID complains against Magistrate Hewawasam
The Police Department is lodging a formal complaint against the Magistrate hearing the case against the Kurunegala doctor Dr Shafi Siyabdeen for his conduct.
The Criminal Investigation Department has sent a complaint against Magistrate Sampath Hewawasam to the acting Inspector General of Police C D Wickremaratne to be lodged before the Judicial Services Commission (JSC), Police Media Spokesman Ruwan Gunesekara told RepublicNext today July 25.
Gunesekara confirmed that the complaint had reached the IGP and further action is expected shortly.
The CID becomes the third complainant against Magistrate Hewawasam, who is hearing the case against Dr Shafi who is embroiled in charges that he rendered hundreds of women infertile against their will while performing caesarian sections.
The other complainants are Dr Shafi’s wife, Dr Imara Shafi and the Sri Lanka Young Journalists’ Association.
The Magistrate’s actions have been questioned by senior doctors as well.
Dr Wilfred Perera the patron of the College of Obstetrics and Gynecology in an open letter sent to the Magistrate asked how Hewawasam permitted the Director of the Kurunegala Teaching Hospital to offer an opinion on the testing of women for infertility in court.
Dr. Perera pointed out that the Director, Dr. Sarath Weerabandara, is a Dentist and does not have the training or the experience to offer an opinion on Obstetrics and Gynaecology.
The CID also objected to Dr. Weerabandara making a statement in court when he was not a party to the case, and the police also pointed out that the Director is a Dentist.
There have also been calls for the Magistrate to recuse himself from the case as his wife Dr Hiroshini Hewawasam is also employed at the same hospital and reports to Dr Weerabandara.
